BBC1 Panorama Documentary

BBC 1 recently broadcasted a Panorama documentary entitled "Can't Pay, Won't Pay". The documentary is about Lenders getting tough on Borrowers who can't repay them and a couple who successfully used the Unenforceable Credit Agreement part of the Consumer Credit Act 1974 to write off almost £100,000 of their own Credit Cards and Loans

However, before you attempt to use the tactics employed by this couple yourself, please watch the end of the documentary. The same couple who successfully wrote off almost £100,000 admit that because they did not fully appreciate the Legal process involved in Court Procedure, they have been forced to pay £100,000 in Lenders Legal fees to one Lender. This is in part due to the fact that they were not Solicitors and were unable to obtain After the Event Insurance 

A summary of this documentary would appear to be: it is possible to write off Unenforceable Credit Agreements, however, unless you want to risk incurring massive Legal fees, it is better to use a Firm of Solicitors to challenge Unenforceable Credit Agreements on a No Win No Fee* basis and ensure the Solicitors obtain After the Event Insurance to protect you from incurring considerable Legal fees
